Terms of Service

Welcome to Gymhur. These Terms of Service (“Terms”) govern your use of our website (gymhur.com) and the manufacturing services provided by Gymhur (“we,” “us,” or “our”), located at Small Industrial Estate, Shahabpura, Sialkot, Pakistan.

By placing an order with Gymhur, you (“the Client”) agree to be bound by these Terms.

1. Custom Orders & Specifications

  • Tech Packs: The Client is responsible for providing accurate Tech Packs, design files, sizing charts, and color codes (Pantone). Gymhur is not responsible for errors resulting from incorrect specifications provided by the Client.

  • Sample Approval: For all custom orders, we will produce a pre-production sample. Bulk production will only begin after the Client approves the sample. Once the sample is approved, the bulk production will follow the specifications of that sample. Any changes requested after approval may incur additional costs.

2. Payment Terms

  • Deposit: A non-refundable deposit (typically 30% of the total invoice value) is required to commence production and purchase fabric.

  • Balance: The remaining balance must be paid in full after the shipment is received from our factory in Sialkot.

  • Methods: We accept payments via Bank Transfer (TT), Western Union, or other methods agreed upon in the invoice.

3. Production & Lead Times

  • Estimates: Lead times provided (e.g., 3-4 weeks) are estimates based on current factory capacity. While we strive to meet all deadlines, unforeseen delays (such as fabric shortages or shipping delays) can occur.

  • Rush Orders: Rush orders may be available for an additional fee but must be confirmed in writing before production begins.

4. Shipping & Customs

  • Incoterms: Unless otherwise agreed, terms are EXW (Ex Works) or FOB (Free on Board) Sialkot.

  • Duties & Taxes: The Client is the importer of record and is responsible for all import duties, VAT, taxes, and customs clearance fees in their destination country (e.g., USA, UK, EU). Gymhur is not liable for delays caused by customs hold-ups.

5. Quality Control & Tolerances

  • Manufacturing Tolerance: Due to the nature of textile manufacturing, a measurement tolerance of +/- 0.5 to 1 inch is considered acceptable industry standard and is not considered a defect.

  • Color Matching: We strive to match Pantone colors as closely as possible. However, slight shade variations may occur between different fabric rolls or between the digital screen and the physical product.

6. Returns & Refunds

  • Custom Goods: As all products are manufactured to your specific custom design, we do not accept returns or refunds for “change of mind.”

  • Defect Policy: If you receive defective items (e.g., wrong size, severe printing error, torn fabric), you must notify us within 7 days of receiving the shipment with photographic evidence.

  • Resolution: If the defect is verified as a manufacturing error, Gymhur will, at its discretion, either remake the defective items or provide a credit/refund for the value of those specific items.

7. Intellectual Property

  • Client Ownership: The Client retains full copyright and ownership of their logos, designs, and tech packs. Gymhur will not sell or distribute the Client’s custom branded products to third parties without permission.

  • Marketing: Gymhur reserves the right to use photos of finished products in our portfolio or on our website to demonstrate our manufacturing capabilities, unless the Client explicitly requests a Non-Disclosure Agreement (NDA).

8. Governing Law

These Terms shall be governed by and defined following the laws of Pakistan. Gymhur and the Client consent that the courts of Sialkot, Pakistan shall have exclusive jurisdiction to resolve any dispute which may arise.
